Terms of Service

These Terms govern your access to and use of the websites, software, mobile apps, and physical goods offered by Backyard Trading LLC. By using our products or buying from us, you agree to these Terms.

1. Acceptance of these terms

By accessing or using any Backyard Trading product, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our products.

2. Eligibility & age

You must be at least 13 years old to use our products, and at least 18 (or 21 where applicable) to use products intended for adults, including sports-data tools such as HotHand. By using our products you represent that you meet these requirements and that your use is lawful in your jurisdiction.

3. Accounts

You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.

4. License to use software

Subject to these Terms and any applicable purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to use our software for your personal or internal business purposes. Open-source components (for example, BajaClaw’s published package) are additionally governed by their stated open-source licenses, which control in case of conflict. You may not resell, sublicense, reverse engineer (except as permitted by law), or remove proprietary notices.

5. Purchases, subscriptions & refunds

Prices are shown at checkout. Payments are handled by third-party processors and, for mobile apps, by the applicable app store. Purchases made through the Apple App Store or Google Play are also subject to that store’s terms and refund policies. Unless stated otherwise or required by law, fees are non-refundable. Subscriptions renew automatically until cancelled; you can cancel through your account or app-store settings.

6. Physical goods

For physical products, title and risk of loss pass to you on delivery to the carrier. Shipping times are estimates. Returns and exchanges, where offered, are described at the point of sale. We are not responsible for delays caused by carriers or customs.

7. Acceptable use

You agree not to:

• Use our products to break the law or infringe others’ rights.
• Interfere with, overload, or attempt to gain unauthorized access to our systems.
• Scrape, resell, or redistribute our data or services without permission.
• Misuse automated agents (including BajaClaw) to attack, deceive, or harm others.

8. Intellectual property

Backyard Trading and our licensors own all rights in our products, branding, and content, except for your own content and third-party open-source components. We grant you no rights other than those expressly stated here.

9. HotHand — informational use only

HotHand provides sports statistics, odds, and analytics for informational purposes only. It is not betting, financial, or investment advice, and we do not guarantee accuracy, availability, or any outcome. You are solely responsible for your decisions and for complying with the gambling laws of your jurisdiction. Gamble responsibly; if you need help, contact a problem-gambling resource such as 1-800-GAMBLER.

10. Disclaimers

Our products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Backyard Trading will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the products is limited to the amount you paid us for the relevant product in the 12 months before the claim, or USD $100 if you paid nothing.

12. Indemnification

You agree to indemnify and hold Backyard Trading harmless from claims and expenses arising out of your misuse of the products or violation of these Terms.

13. Termination

We may suspend or terminate access if you violate these Terms or to protect our products and users. You may stop using the products at any time. Sections that by their nature should survive (such as IP, disclaimers, and liability) survive termination.

14. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The exclusive venue for disputes will be the state or federal courts located in California, unless applicable law requires otherwise.

15. Changes to these terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, provide additional notice. Continued use after changes take effect means you accept the updated Terms.
